This End User License Agreement (“Agreement”) is a legally binding contract between you (“User”) and prettysmart GmbH (“Provider”) regarding the use of the Seemee App (“App”).
By creating an account or using the App, you confirm that you have read, understood, and accepted this Agreement. If you do not agree, you may not use the App.
 

1. License Grant

You are granted a personal, non-exclusive, non-transferable, and revocable license to use the App in accordance with this Agreement.
All rights to the App, including software, design, and branding, remain with the Provider.
 

2. User Obligations

Users agree to:

• provide accurate and truthful registration data,

• not publish or distribute any content that is unlawful, harmful, offensive, threatening, defamatory, obscene, discriminatory, violent, or otherwise unacceptable,

• not distribute spam, misleading, or automatically generated content,

• not violate the rights of third parties (e.g. copyrights, trademarks, personality rights),

• not manipulate, hack, or misuse the App.
   

3. User-Generated Content

• Users remain solely responsible for the content they create, upload, or share.

• The Provider does not actively monitor all content but reserves the right to remove or restrict any content that violates this Agreement or applicable law.

• Abuse of the reporting function (e.g. false accusations) may lead to account suspension.
   

4. Enforcement & Sanctions

The Provider reserves the right to:

• suspend or permanently delete accounts that violate this Agreement,

• remove or block content that is harmful, unlawful, or unacceptable,

• restrict or deny access to the App if necessary to protect the community.
   

5. Termination & Deletion

• Users may request the deletion of their account at any time via the App function or by email to privacy@seemee.live.

• Upon termination, access to the App and user-generated content ends.

• Certain data may continue to be stored for legal reasons (e.g. payment or financial records).
   

6. Right of Withdrawal

You have the right to withdraw from this Agreement within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the date of registration of your user account.

To exercise your right of withdrawal, you must inform us (prettysmart GmbH, Nentmannsdorf 79, D-01819 Bahretal, Germany, email: privacy@seemee.live) by means of a clear statement (e.g. by email).
 

Consequences of Withdrawal
If you withdraw from this Agreement, your account will be restricted, and you will no longer be able to upload or create content until you re-accept the EULA. Already completed transactions or legally required data (e.g. payment records) remain unaffected and will be stored in accordance with legal retention obligations.
 

Exclusion / Early Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely if you expressly agree, before the withdrawal period has expired, that we may begin fulfilling the contract (e.g. by uploading or creating content).
 

7. Changes & Updates

The Provider may update this Agreement from time to time.
Users will be notified of material changes within the App. Continued use after such changes constitutes acceptance.
 

8. Limitation of Liability

• The App is provided “as is” without warranties.

• The Provider is not liable for user-generated content or for damages resulting from misuse of the App.

• Statutory consumer rights and liability in cases of intent or gross negligence remain unaffected.
   

9. Governing Law

This Agreement is governed by the laws of Germany.
The place of jurisdiction is Dresden, Germany, unless mandatory law provides otherwise.
